These Terms of Service ("Terms") are an agreement between you and NSIMS LLC ("Embers", "we", "us"), a Delaware limited liability company, governing your use of the Embers website and service at embers.group. By creating an account or using Embers, you agree to these Terms.
Embers helps you keep your professional relationships warm. It surfaces the people worth reaching out to, drafts messages in your voice, and lets you approve them. Embers prepares drafts; you decide what is sent. Nothing is sent on your behalf without your approval.
You are responsible for your account, for keeping your sign-in credentials secure, and for the activity that happens under your account. Provide accurate information and keep it current.

You own the data you put into Embers. You grant us the limited license needed to host and process it in order to provide the service to you. You are responsible for the content of the messages you approve and send.
Embers offers a free plan and may offer paid plans. If you subscribe to a paid plan, the price, billing period, and renewal terms will be presented at checkout, and paid fees are non-refundable except where required by law. We may change plan features or pricing on a going-forward basis with notice.
Embers is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any draft it prepares is appropriate to send. You are responsible for reviewing every message before you approve it.
To the fullest extent permitted by law, NSIMS LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
You agree to indemnify and hold NSIMS LLC harmless from claims arising out of your use of the service, your content, or your violation of these Terms or any law.
You may stop using Embers at any time. We may suspend or terminate access if you violate these Terms or use the service in a way that creates risk or legal exposure. You can delete your account and data from within the product.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute that is not subject to other agreed resolution.
We may update these Terms from time to time. We will revise the "last updated" date above and, for material changes, notify you in the product. Continued use after a change means you accept the updated Terms.
